1. Role of the Agent
Homelet acts solely as an intermediary between landlords, tenants, and any relevant third parties in relation to property lettings, tenancy applications, and associated services. Homelet does not own, manage, or control the properties listed unless expressly stated in writing.
2. Property Information
All property descriptions, photographs, floor plans, and marketing materials are provided for guidance only. While every effort is made to ensure accuracy, Homelet cannot guarantee that all information is complete, current, or free from error. Prospective tenants must satisfy themselves as to the suitability and condition of any property before entering into a tenancy agreement.
3. Tenancy Agreements
All tenancy agreements are legally binding contracts between the landlord and the tenant. Homelet is not a party to the tenancy agreement unless explicitly stated. Any rights, obligations, disputes, or claims arising from the tenancy agreement are strictly between the landlord and the tenant.
4. Applications and Referencing
Submission of an application does not guarantee acceptance of a tenancy. Landlords retain the sole and absolute discretion to accept or decline any applicant. Referencing, affordability checks, and background checks may be conducted by independent third-party referencing providers. Homelet accepts no responsibility for decisions made by landlords or third-party referencing agencies.
5. Third-Party Services
During the lettings process, services may be provided by third parties including, but not limited to:
- Referencing agencies
- Inventory companies
- Contractors or maintenance providers
- Deposit protection schemes
- Utility or service providers
Homelet is not responsible for the actions, omissions, services, delays, or decisions of any third party involved in the tenancy or application process.
6. Move-In Arrangements
Move-in dates, property readiness, inventories, keys, and access arrangements are subject to landlord confirmation and circumstances beyond the control of Homelet. While reasonable efforts will be made to coordinate move-in arrangements, Homelet shall not be liable for delays, inconvenience, or dissatisfaction relating to move-in or property availability.
7. Property Condition and Repairs
Responsibility for the condition, maintenance, safety, and legal compliance of the property rests with the landlord unless a separate property management agreement is in place. Any maintenance issues, repairs, or complaints relating to the property should be directed to the landlord or managing agent as applicable.
8. Limitation of Liability
To the fullest extent permitted by law, Homelet shall not be liable for any loss, damage, cost, delay, inconvenience, or claim for compensation arising from:
- A tenancy application or referencing process
- Decisions made by landlords or third parties
- Property condition or maintenance issues
- Delays in move-in arrangements
- Errors or omissions in property marketing materials
- Any dispute between landlord and tenant
Under no circumstances shall Homelet be responsible for indirect, consequential, or financial losses suffered by landlords, tenants, or any third party.
9. No Compensation
By using the services of Homelet, submitting an application, or entering into a tenancy arranged by Homelet, both landlords and tenants acknowledge and agree that Homelet will not be liable for compensation, damages, or financial claims relating to the lettings process, tenancy arrangements, or services provided by third parties.
10. Legal Compliance
Nothing in this disclaimer excludes or limits liability where such limitation is prohibited under applicable UK law, including statutory rights afforded to consumers.
